[google.com] It happens and there's always one patent examiner who doesn't do the job correctly, but that's the overall problem with patent reform right? Laws change, rulings can be overturned but for now at least you can't patent an algorithm. You can patent a software invention however that uses algorithms but that software invention must be innovative and unique.
